Kimberly Zapata, the former deputy director of the Milwaukee Election Commission, is on trial for misconduct in public office, a felony, and three misdemeanor counts of making a false statement to obtain an absentee ballot. In Milwaukee County Circuit Court, Zapata's defense attorney Daniel Adams told the jury that she committed no crime, the Milwaukee Journal Sentinel reported. Those details offer a stark contrast to the voter-fraud conspiracy theories Trump began spreading publicly just weeks later and continued to use to question the 2020 election results. Investigators seemed particularly interested in understanding Trump’s mindset about election security before he embarked on a monthslong campaign to cast doubt on elections, the source added. After losing the 2020 election, Trump repeatedly made false claims that contradicted what he was told at the White House briefing about the security of voting systems. The briefing grew tense when the topic turned to Moscow’s preference for Trump over Joe Biden in the 2020 election, the sources said.

Democrats sued Monday demanding that undated or incorrectly dated mail-in ballots be counted in Pennsylvania's election, which could end up determining which party controls the Senate. The lawsuit, filed in part by Democratic Senate candidate John Fetterman's campaign, argues that a provision in state law requiring that mail-in ballots include the date on the outside of the envelopes violates federal law. Civil rights groups, including the American Civil Liberties Union and the NAACP, filed a similar complaint Friday against state election officials. The U.S. Supreme Court cleared the way in June for election officials in Pennsylvania to count undated mail-in ballots. The justices ruled that undated ballots in a state race last year should be counted.

Milwaukee officials dismissed the city’s deputy director of its elections commission, saying she fraudulently requested absentee military ballots and then passed them along to a state representative, Mayor Cavalier Johnson said Thursday.
